You agree to be bound by the following terms and conditions when ordering items from Pro-Tential Pty Ltd ABN 32 155 964 248 (“Genuine Gear”) through www.genuinegear.com.au.

ORDERS

Your order, once submitted to Genuine Gear, is final and cannot be changed. This includes adding or removing items from your order.

Genuine Gear reserves the right to reject any order you place, and/or to limit quantities on any order, without giving any reason.

PAYMENT

Payment for items may be by:

  • Credit card (Visa or Mastercard) A surcharge of 1.5% of the order value (cost of item/s plus any shipping costs) will apply and the surcharge amount will be specified at checkout)
  • Paypal (no surcharge);
  • An alternative method agreed to by Genuine Gear.

Any credit card surcharge paid by you will not be refunded if:

  • your order or part of your order is cancelled at your request; and / or
  • any item in your order is returned due to your change of mind or mistaken purchase; and / or
  • any item in your order is returned to us as ‘return to sender’ by Australia Post or any courier that we use to ship your order; and or
  • any item in your order is returned and is deemed not to be faulty.

GST / TAX INVOICE

The prices of items on www.genuinegear.com.au are inclusive of Goods and Services Tax (“GST”). Genuine Gear makes no warranty or representation regarding the applicability of GST to orders made outside of Australia.

SHIPPING

Delivery times

Item/s will be dispatched from Oakleigh, Victoria, within 24 hours (excluding weekends and public holidays) after full payment has been received by Genuine Gear as cleared funds. Exceptions apply for pre-sale/pre-order items, where delivery times will be indicated on our website.

The following is a guideline of delivery times:

  • 2 - 6 business days for item/s sent by Regular Post within Australia
  • 1 - 3 business days for item/s sent by Express post within Australia
  • 3 - 5 business days for item/s sent by Express Courier International to New Zealand
  • 4 - 10 business days for item/s sent by Air Mail to New Zealand

Free standard shipping

For item/s which include free standard (Regular Post) shipping, postage is only FREE for the first delivery attempt to you. If there is any delivery failure not caused by Genuine Gear, a shipping fee must be paid in full by you before Genuine Gear resends the item/s to you.

Registered Post / shipping insurance

Please note that the Australia Post Regular Post service does not include a tracking number or insurance. Genuine Gear is not liable for any loss, theft, or damages to items during shipping / delivery. Genuine Gear recommends Registered Post which includes a tracking number and insurance up to $100. If you would like your item/s to be sent via Registered Post, please let us know prior to payment so that we may provide you with a new shipping quotation.

INTERNATIONAL ORDERS

Genuine Gear currently ships to Australia and New Zealand.

RETURNS AND EXCHANGES

Non-faulty items

For change of mind or incorrect choice purchases, you can return your item to Genuine Gear within 30 days of purchase for a refund if it is brand new with unopened packaging. Genuine Gear offers refunds only, not exchanges.

Genuine Gear may elect to charge a restocking fee of 20% of the value of the item for any change of mind or incorrect choice purchases, and this will be deducted from the refund amount. Also, any shipping costs you incurred (that is, where ‘free shipping’ was not specified) when the item was initially sent to you will not be refunded. Further, any credit card surcharge that you paid in relation to your order will not be refunded.

If the item returned is damaged (excluding faulty items) or not in brand new and unopened condition, Genuine Gear reserves the right to refuse to issue a refund. Genuine Gear may, at our sole discretion, proceed with a refund but will deduct a further 20% off from the purchase price.

Faulty items

If you consider that there is a fault or defect with any item, please return the item to Genuine Gear within a reasonable time of purchase for assessment.

If the item is found to be faulty then you may request:

  • a refund of the item purchase price; or
  • a replacement of the item; or
  • Genuine Gear to assist in making a claim under any warranty which applies to the item.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Unless otherwise specified in the item description, on or in the item packaging or in written material provided with the item, Genuine Gear will replace any item with a manufacturing defect within 12 months of the date of purchase. This warranty does not cover:

 

  • any exclusions outlined in the manufacturer’s warranty which apply to the item;
  • accidental misuse, deliberate misuse or unauthorised alterations;
  • accidental damage;
  • liquid penetration;
  • rust or corrosion;
  • cosmetic damage;
  • reasonable wear and tear.

 

The benefits under our warranty are in addition to other rights and remedies under applicable law in relation to the goods.

If the item is not found to be faulty then you will be responsible for all shipping and handling costs incurred by Genuine Gear to resend the item to you. The item will only be resent to you after these costs are received in full by Genuine Gear as cleared funds.

Item not what you ordered

In the unlikely event that Genuine Gear sends you an item which is not what you ordered, please contact us within 2 business days of receiving your item at sales@genuinegear.com.au so that we can rectify this for you.

ITEM DESCRIPTIONS AND IMAGES

Genuine Gear aims to ensure that item descriptions and images are accurate. However, some inaccuracies, typographical errors or misinterpretations may occur. Genuine Gear reserves the right to correct such inaccuracies or typographical errors.
